The following constitute the terms and conditions under which The Bnak Corporation (Bnak) offers access to this web site and all information, products and services herein. By using this web site or Swiftcoin now or in the future, you agree to be bound by these Terms and Conditions:

Introduction

Bnak, including www.firstnationalbnak.com and any related links, web sites, services, products and tools, require that you agree to the following terms and conditions, which also apply to our partners, subsidiaries, affiliates, employees, contractos, etc.

Scope

Before you open an account at Bnak or use Swiftcoin, you must accept all of the our terms, stated and unstated;our User Agreement and our Privacy Policy. You agree that the User Agreement and Privacy Policy apply whenever you use Bnak sites or services or when you use the tools we make available to interact with Bnak sites and services or whenever you use Swiftcoin, even Swiftcoin you own, now or in the future.

Using Bnak

While using Bnak sites, services and tools, you will not:

• make false or bogus offers,claims or suggestions involving Swiftcoin or defraud anybody in any way;
• violate any laws, third party rights or our policies;
• use our sites, services or tools if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from using our sites, services or tools;
• manipulate Swiftcoin, Solidus Bonds or user accounts thereof;
• distribute viruses or any other technologies that may harm Bnak, or the interests or property of Bnak users;
• export or re-export any Bnak tools except in compliance with the export control laws of any relevant jurisdictions;
• copy, modify or distribute rights or content from Bnak sites, service or tools or Bnak's copyrights and trademarks;
• harvest or otherwise collect information about Swiftcoin users, including email addresses.

Infringing On Our Rights

Without limiting other remedies, we may suspend or terminate any user accounts, prohibit access to our sites and its content, services and products, including Swiftcoin; take technical and legal steps to keep users off our sites if, in our sole opinion, they are creating possible problems, spying, trolling or acting inconsistently with the letter or spirit of our business or policies.

Bnak Limits of Liability

Bnak is not responsible for and can not guarantee the successful outcome of any financial or commercial transaction conducted on or off any web site with Swiftcoin or any other currency and all Bnak users agree to hold Bnak, its subsidiaries and assigns completely harmless in the event of any dispute, misunderstanding, accident, technical problem, fraud, misrepresentation, false claim, 3rd party damages or problem of any kind now or in the future.

Limitation of Liability

Bnak does not guarantee continuous or secure access to any web site, product or service or operation of our Bnak exchange; Bnak and Swiftcoin may be hampered by any number of factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties. We are not liable for any loss of money, goodwill or reputation, or any special, indirect or consequential damages arising, directly or indirectly, from any inability to use our sites, services and products, including Swiftcoin.

Regardless of the previous paragraphs, if we are found to be liable, our liability is limited to US$100.00

Privacy

We do not collect, keep or record the private details of users or visitors to our web site(s).

We do not collect or release any information about individual Bnak exchange clients, Swiftcoin buyers and sellers, web site users or web site visitors. We view protection of users' privacy as the cornerstone of our business model and reputation. We do not send advertising, reminders or any other communications to clients or web site visitors. Cookies are not required to use our services or trade in Swiftcoin.

Indemnity

You indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim or demand, including reasonable attorneys' fees, arising out of any controversy,dispute, legal action or violation of law.

No Agency

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

Notices

Except as explicitly stated otherwise, legal notices shall be served on Bnak Corporation's registered agent or to the email address you provide to Bnak during the registration process. Notice shall be deemed given 24 hours after email is sent.

Resolution of Disputes

If a dispute arises, it is agreed that we will resolve any claim at law or equity in accordance with one of the subsections below or as we otherwise agree in writing. Before resorting to these alternatives, we encourage you to contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures as alternatives to litigation.

Law

This Agreement shall be governed in all respects by the laws of Hong Kong. You agree that any claim or dispute against Bnak must be resolved exclusively by a judge in Hong Kong. You agree to submit to the personal jurisdiction of the courts located within Hong Kong for the purpose of litigating any claims or disputes.

Bnak clients and Swiftcoin buyers and sellers are prohibited from using Swiftcoin or Bnak for transactions involving child pornography, money laundering, illegal drugs or illegal arms.

This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter herein. The following Sections survive any termination of this Agreement: Privacy, Limits of Liability, Indemnity and Resolution of Disputes.
